Mission Statement:

A collection of some of the finest cycling coaches around led by British Cycling Level 3, multi award winning and BikeEtc magazine guru Pav Bryan. We want you to succeed. Our mission is simple; to help you improve on your terms. We will make the training work for you, we will establish exactly what you need to do in order to reach your goals with the journey but suited to your commitments and commitment.

By using any of my services, taking part in any of my competitions or being on my newsletter mailing list you are agreeing to the following terms and conditions

Definitions: The Coach – (Pav Bryan)
The Rider – (The Client, You)

The Coach’s Responsibilities:

To professionally assess all Riders.

To devise a suitable and professional training and development plan tailored to the Riders’ needs.

To provide the Rider with services in line with the package they have signed up for.

To treat all Riders with respect.

Sessions:

Please arrive promptly for your session. If The Rider arrives early The Coach may not be able to greet The Rider. Sessions are not for a fixed length of time, however Riders are scheduled at one and a half hourly intervals.

Sessions are designed for The Rider’s maximum gain, however any progress will be equal to the vigour of effort put forth by the Rider. Accordingly, The Coach gives no guarantees that the Rider will make significant improvement at any time.

Training Plans:

Training plans are sold on a minimum 6 months basis. Please see price list for further information. Training plans will not be commenced until payment is secured.

In order for an effective training plan to work feedback from The Rider is essential. The Rider is required to complete the session notes in TrainingPeaks. This will enable The Coach to refine your plan to match your fitness levels. If the Client fails to regularly provide feedback then The Coach will not be responsible for loss of fitness or fatigue arising from over exercise, or loss of form and performance from not training hard enough.

There are no guarantees that a training plan will help The Rider improve. It is vital that The Rider commits to the plan and regularly provide relevant feedback.

Training Packages:

Training Packages are subject to change. It is the Rider’s responsibility to ensure relevant sessions are booked in order to receive quoted discounts or free sessions. Package benefits do not apply after the package ends.

Outdoor Group Sessions:

The Coach will carry out a bike, helmet and clothing check.

The Coach will not allow any rider who does not have suitable bike, helmet or clothing to participate in the session on a practical level. Definitions are as follows:-

The Rider is to wear suitable clothing: defined as appropriate for the weather, not loose around the hands or feet, protective clothing is accepted but must not interfere with rider movement.

Suitable bike: defined as having two workable brakes fitted with a free wheel and suitable for road cycling.

Suitable helmet: being of suitable size for rider, strapped under the chin and fitted correctly on the Rider.

Indoor Sessions:

The Rider is to wear suitable clothing.

Your Responsibilities:

It is vital that the Rider must arrive to sessions able to give 100% commitment to training. The Rider must seek medical advice before starting any training under the prescription of the Coach. The Rider must seek new medical advice when applicable and inform the Coach of any symptoms of conditions that may affect training. The Rider must stop training if at any point they suspect they may become injured or unwell.

Outdoor Sessions:

The rider will need to supply his/her own bike with appropriate features and two working brakes.

The Rider must arrive to all sessions with a safety helmet as the Coach will not commence a session without it.

When the coach blows the whistle the rider must stop all activity and focus on him.

All Sessions:

The Coach will allow access to parents into sessions as spectators only (they are advised to attend the beginning of the first session at minimum) but the Coach asks that parents do not communicate with son/daughter or disrupt the session in any other way.

All mobile phones are to be switched off, there are to be no distractions during the session.

The Rider must behave respectfully to the Coach at all times.

Riders are required to remove all breakable appendages before mounting.

It is the Rider’s responsibility to inform the coach of any physical, medical conditions prior to any session and any ensuing changes or developments thereafter.

The rider must not rely on the coach to make any mechanical adjustments to his/her bike.

Cycling Training Camps and Holidays:

Cycling Training Camps and Holidays will be booked through a tour operator. The Coach will not be held liable for any ensuing claims or disputes between The Rider and the tour operator.

Charges:

All charges are made exclusive of VAT.

VAT will be applied when necessary.

Payment:

All coaching packages are to be paid via our GoCardless system, any deviations from this will incur a 5% transaction fee. All other services are to be paid for in advance by cash, bank transfer or standing order.

Alternatively a 7 day invoice will be issued which will extend to 30 days after which an 8% above base rate interest charge will be applied.

In the event of any non-payment of invoice or direct debit after 30 days, the Coach reserves the right to pursue payment and claim interest at 8% above base rate plus £40 administrative charges together with compensation under the Late Payment of Commercial Debts Act 1998.

Cancellation by the Coach:

If the Rider misses two consecutive sessions then the Coach reserves the right to cancel the cycling programme.

The Coach reserves the right to refuse training to any Rider who is not sufficiently committed to sessions and reaching their goal.

If the Coach cancels a session due to unforeseen circumstances the Coach will not be held liable for any incidental charges incurred by the rider, in this circumstance the Coach will offer an alternative session convenient to the rider, at his discretion and with due consideration.

Cancellation by the Rider:

The Client will be billed for cancellations at point of missed session/sessions.

The Coach reserves the right to charge at a later date.

At least 48 hours’ notice is required for cancellation. Acceptance of less than 48 hours’ notice will be at The Coaches discretion. In the event that less than 48 hours’ notice is given a fee between £10.00 and up to 100% of session/sessions cost will be payable whichever is the greater.

Training Packages – Cancellation of any package plan will require one months’ notice. In the event of cancellation of packages all discounts and concessions will be null and void therefore full fees will be payable for packages taken.

Cancellation within 14 day cooling off period – You have the right to cancel any training package within 14 days of returning your Rider Profile forms. There will be a setup fee payable equivalent to five hours work (Tier One & Two price per hour is £30.00 and Tier 3 is £50.00).

Cancellation within minimum term – Cancellation of any package within the minimum term will require one months’ notice. There will be a setup fee payable equivalent to five hours work (Tier One & Two price per hour is £30.00 and Tier 3 is £50.00).

Refunds:

Due to the nature of the service, refunds are not applicable on sessions or any training plan already received by the Rider.

Complaints:

The Coach takes his job very seriously and will listen to all complaints and deal with them in an honest and professional manner. All complaints should be submitted in writing and will be responded to with within 14 days of receipt. Limitations of Liability:

With respect to any services provided under this agreement and any breach of this agreement is solely limited to the amount the Rider paid for such services. The Coach shall not be held liable for any direct, indirect, incidental, special or consequential damages resulting from the use or liability to use any of his services or for the cost of procurement of substitute services. The Coach’s total liability to the rider is extended to the range of liability contained within The Coaches British Cycling Insurance which includes Third Party (public) liability and professional indemnity insurance. This policy does not include: bike insurance, travel insurance or cycle breakdown rescue.

Data Protection:

The Coach will not share The Rider’s personal data with any third party without The Rider’s prior consent. The Coach will hold Rider Information in a secure environment and for the length of time necessary by law. Rider data is also held on The Coaches website service provider’s servers. The Coach takes no responsibility for any data on these servers.

 

Contract Specific Terms:

These terms are specific to Riders’ who are signed on a contract basis only.

Minimum term contract runs from date signed to the date agreed in the package. Cancelation will not be accepted within the minimum term.

It is the client’s responsibility to book all sessions. For all sessions, including free training, please give a minimum of 48 hours’ notice. Failure to do so will result in a cancellation fee equivalent to the full price of the session.

 

Miscellaneous:

The Coach reserves the right to make any changes to these terms and conditions without giving any prior notice. The Coach may add or alter these terms and conditions from time to time and any alterations or additions will apply to new business not existing Clients.
